Introduction Welcome to Kristof Media Co. By engaging in business with us, you agree to abide by the policies outlined in this document. Please read this policy carefully before proceeding with any services.
1. Payment Terms
- A non-refundable retainer is required upon booking to secure services.
- Payments must be made via debit or credit card through Kristof Media Co.’s POS system. Cash payments require explicit approval.
- Late payments are subject to a $25 initial fee and an additional $20 per day thereafter, up to 15 days, after which legal action may be taken.
- Sales tax of 8.25% applies to all transactions.
- Net10 and Net15 payment terms apply by default; deviations will incur a 10% penalty.
2. Service Delivery
- Services will be provided at the agreed-upon location and time.
- Clients are responsible for travel and accommodation costs for projects outside the Dallas-Ft. Worth area.
- Rescheduling requires a minimum 48-hour notice and must commence within two weeks; otherwise, fees paid are forfeited.
3. Intellectual Property & Usage Rights
- Kristof Media Co. retains all copyrights to media produced.
- Clients may use images for personal use but may not resell, alter, or remove logos without written permission.
- Commercial use requires a separate licensing agreement.
4. Cancellation & No-Show Policy
- Cancellations require a 60-day notice. Failure to provide notice will result in a penalty of 30% of the full invoice.
- No-shows will result in forfeiture of payments made and a 30% penalty of the total invoice.
- Monthly contracts require a two-month service fee for early termination.
5. Grace Period & Late Arrivals
- A 20-minute grace period applies to scheduled sessions. Beyond 20 minutes, a $25 late fee will be charged.
- After 40 minutes, rescheduling is required, along with an additional billable hour charge.
6. Re-Shoots & Creative Direction
- Re-shoots are at the sole discretion of Kristof Media Co. and are not granted for personal aesthetic preferences.
- Clients must actively participate in the creative direction process to ensure their vision is met.
7. Archival & Storage
- Media files will be available for two weeks post-project completion.
- After one month, Kristof Media Co. is not responsible for retaining client files.
8. Model Release & Promotion
- Clients consent to Kristof Media Co. using project media for marketing and promotional purposes unless otherwise agreed.
9. Liability & Indemnification
- Kristof Media Co. is not liable for personal injuries or damages to venues/equipment beyond its control.
- Clients assume responsibility for the safety of all media upon receipt.
10. Force Majeure & Unforeseen Circumstances
- Services may be rescheduled in the event of natural disasters, war, or other uncontrollable circumstances.
- If Kristof Media Co. is unable to perform services, a refund or credit will be issued based on services rendered.
